1. What this policy is for
SENDA is a New Zealand peer-to-peer marketplace. It connects people who need an item moved (Senders) with people who have spare vehicle space on a trip they are making anyway (Runners).
This document sets the rules for using the Platform. It is written so both sides know what they are agreeing to before a job is accepted: who does what, what cannot be carried, how money is held, what happens if something goes wrong, and how people are expected to treat each other.
2. How the marketplace works
- A Sender posts a Job, including but not limited to: item description, photos, pickup and drop-off address, preferred timing, and a price they are willing to pay (or an invitation for quotes).
- Verified Deliverers can accept the listed price or submit a quote.
- The Sender accepts one offer. Payment is taken and held in escrow by the payment provider until the Job is confirmed complete.
- Pickup and drop-off are coordinated in-app. Photo confirmation is required at both ends.
- The Sender confirms delivery (or confirmation auto-releases after a set period if there is no dispute). Funds are then released to the Deliverer, less the Platform fee.
- Both parties rate each other. Ratings affect visibility and continued access to the Platform.
3. Legal nature of the relationship
3.1 SENDA is not the carrier
SENDA LINK LIMITED operates the Platform only. SENDA is not a courier, freight forwarder, postal operator, or contracting carrier under Part 5, Subpart 1 of the Contract and Commercial Law Act 2017 (CCLA).
When a Job is accepted, a separate contract of carriage is formed between the Sender and the Deliverer. Unless the parties expressly agree otherwise in writing through the Platform, that contract is at owner's risk: the Runner is liable only for loss or damage they cause intentionally. The Sender remains responsible for insuring the item if they want cover above that.
SENDA may facilitate communication, identity checks, escrow, photo records and dispute handling. Doing those things does not make SENDA a party to the carriage contract and does not make SENDA responsible for the item.
3.2 Independent contractors
Runners are independent contractors, not employees, agents, or partners of SENDA. They choose which Jobs to take, use their own vehicle, set or accept their own price, and control how they complete the trip (subject to law and this policy). Nothing in these terms creates an employment, joint-venture or agency relationship.
3.3 Consumer law still applies where it applies
If a user is a consumer, the Consumer Guarantees Act 1993 and Fair Trading Act 1986 may still apply to SENDA's own services (the Platform itself — matching, payments tooling, and support). Those statutes cannot be contracted out of for consumers in the usual way. This policy does not attempt to do so.
4. Eligibility and accounts
- Users must be 18 or older and legally able to enter a contract in New Zealand.
- Runners must hold a current New Zealand driver license of the class required for the vehicle they use, and the vehicle must be registered, warranted (where required) and roadworthy.
- Runners must complete identity verification before they can accept Jobs. SENDA may use a third-party ID provider.
- SENDA may require a Ministry of Justice criminal history check or equivalent for Runners. Failure or refusal can mean the account stays in Sender-only mode or is declined.
- One person, one account. Sharing logins, creating multiple accounts to evade a ban, or using someone else's identity is grounds for immediate suspension.
- Business users must be authorised to bind the business they represent.
SENDA may refuse, suspend or close an account where it reasonably believes these terms, the law, or other users' safety would otherwise be at risk.
5. Vehicle, insurance and driving standards
Standard personal motor policies in New Zealand commonly exclude courier, delivery, and 'hire or reward' use. A Runner who accepts paid Jobs on SENDA may have no cover if they have not told their insurer and arranged appropriate business or goods-in-transit cover.
- Runners should check with their insurer before accepting paid Jobs and must maintain whatever cover is required for the way they actually use the vehicle.
- SENDA does not currently provide goods-in-transit insurance for items on a Job. Senders who need cover should arrange it themselves or only list items they can afford to lose.
- Deliverers must obey the Land Transport Act 1998, road rules, speed limits, and fatigue common sense. No alcohol or impairing drugs while completing a Job.
- The vehicle used must be suitable for the item (size, weight, weather protection). If it is not, the Runner must decline the Job.
- SENDA may later offer optional embedded goods-in-transit cover per Job. Until that product exists and is described in-app, users should assume there is none.
6. What can and cannot be sent
6.1 Allowed items (typical)
Household goods, boxed parcels, furniture, sporting gear, tools, and similar lawful personal or business items that fit safely in the Runner's vehicle, are not on the prohibited list, and are accurately described and photographed.
6.2 Prohibited items
The following must not be listed, accepted or carried on SENDA. This list is not exhaustive. If in doubt, do not send it.
- Anything illegal to possess, sell or transport in New Zealand, including controlled drugs and stolen goods.
- Firearms, ammunition, weapons, weapon parts, replicas intended as weapons, pepper spray, and similar restricted items.
- Explosives, fireworks, flares, and other dangerous goods that require specialised DG handling (unless SENDA later publishes a specific dangerous-goods programme).
- Cash, bullion, negotiable instruments, unactivated high-value stored-value cards, and similar valuables.
- Jewellery, watches, precious metals or stones above a declared value of NZ$500 unless the Sender has arranged their own insurance.
- Human remains, body parts, bodily fluids, or biological specimens.
- Live animals (including pets), livestock unless expressly agreed by the Runner.
- Age-restricted products such as: alcohol, tobacco, vaping products, and related paraphernalia.
- Perishable, frozen or refrigerated food unless the Job description and accepted offer clearly include a timeframe and method that will keep the item safe, and the Runner has agreed in writing in the Job chat.
- Items that would require export from New Zealand, or movement into a place where that item is restricted (including some plants, soil, and biosecurity risk goods).
- Inadequately packaged items that can leak, puncture, or injure.
- Anything the Sender cannot lawfully give to another person to carry.
6.3 Restricted items — extra conditions
- Fragile items (glass, ceramics, screens): Sender must pack to survive ordinary road handling. Photograph packing before pickup.
- High-value items (over NZ$500 declared value): Sender should arrange their own insurance. Carriage is still at owner's risk.
- Items needing two people to lift: the Job must say so. A Runner is not obliged to lift beyond what one reasonably fit adult can manage safely.
- Lithium batteries and devices containing them: only when installed in consumer devices, not loose damaged cells.
A Runner who discovers a prohibited item at pickup must refuse the Job, photograph the item if safe to do so, and report it through the app. Escrow is refunded to the Sender minus any reasonable call-out the parties already agreed.
7. Sender responsibilities
- Describe the item honestly: size, weight, quantity, fragility, and any handling notes.
- Pack the item so it can survive a normal road trip. SENDA is not a packaging service.
- Be present (or have an authorised person present) at the stated pickup window.
- Give the Runner access that is lawful and safe. Do not ask them to enter a property they are not comfortable entering.
- Do not conceal prohibited items inside an allowed item.
- Confirm delivery promptly, or raise a dispute with photos within the dispute window.
- Pay only through the Platform. Off-platform payment is a breach and removes escrow protection.
8. Runner responsibilities
- Only accept Jobs the vehicle, license, schedule and physical capability can actually complete.
- Inspect and photograph the item at pickup before leaving. If it is not as described, decline or renegotiate in-app before driving off.
- Take reasonable care of the item while it is in the vehicle. Do not leave it on display in an unattended vehicle in a way that invites theft if that can be reasonably avoided.
- Follow the agreed route timing in good faith. If delayed, message the Sender in-app as soon as possible.
- Photograph drop-off and obtain confirmation (or leave only where the Job explicitly allows a safe-place drop).
- Do not subcontract a Job to someone who is not the verified account holder.
- Do not use SENDA to move their own illegal goods or to reconnoitre addresses.
9. Payments, fees and cancellations
9.1 Escrow
When a Sender accepts an offer, the agreed amount is charged and held by the payment provider. SENDA is not a bank and does not hold customer funds on its own balance sheet except as the payment provider's flow of funds and any platform fee allow.
Default release: funds release to the Deliverer when the Sender taps confirm, or automatically [72 hours] after the Runner marks delivered with drop-off photos if the Sender has not opened a dispute.
9.2 Platform fee
Runners receive 90% of the completed Job price; SENDA retains 10% as the platform fee. GST treatment to be confirmed with an accountant once the company is GST-registered. The fee is earned when a Job completes. It is not a freight charge.
9.3 Cancellations
- Sender cancels before a Runner is accepted: full refund, no fee.
- Sender cancels after acceptance but before pickup, with more than [2 hours'] notice: full refund minus a small admin fee if payment processing costs are incurred.
- Sender cancels after the Runner is already travelling to pickup, or is a no-show at pickup: Runner may be awarded a call-out of up to [25%] of the Job price from the escrow, at SENDA's reasonable discretion based on chat and location evidence.
- Runner cancels after acceptance without a good reason (vehicle breakdown with evidence is a good reason; finding a better Job is not): SENDA may refund the Sender in full, warn or suspend the Runner, and adjust ratings.
- Force majeure (crash, sudden illness, road closure, extreme weather): best-effort re-match or full refund. No penalty where the party acted reasonably and communicated.
10. Safety and community standards
SENDA is a community of people sharing trips. The following is required, not optional.
- Treat the other party with ordinary Kiwi courtesy. No harassment, slurs, sexual comments, threats, or pressure to meet off-platform.
- Do not ask for or share another user's private address, workplace or phone number outside what the Job requires.
- Meet in a public, well-lit place where possible. A driveway or building lobby is fine; an isolated rural gate at night is a reason to reschedule or cancel.
- In-app chat is the official record. Keep coordination there so disputes can be reviewed.
- Do not weaponise ratings (revenge 1-stars for a price disagreement after a successful delivery).
- Report safety incidents immediately through the app and, if someone is in danger, to Police on 111.
SENDA may share information with Police or other agencies where it reasonably believes that is necessary to prevent or detect a crime, or where required by law.
11. Ratings, records and enforcement
After each completed or cancelled-after-acceptance Job, both parties may rate the other and leave a short comment limited to the Job.
SENDA may hide, edit or remove comments that are abusive, doxxing, or about matters unrelated to the Job.
Repeated low ratings, cancelled Jobs, prohibited-item attempts, off-platform payment requests, or safety reports can lead to a warning, temporary hold on new Jobs, or permanent ban. SENDA does not have to give a detailed statement of reasons where doing so would compromise another user or an investigation.
12. Loss, damage and disputes
12.1 Default position
Because carriage is at owner's risk unless the parties agree otherwise, the Sender should assume that if an item is lost, stolen or accidentally damaged in transit, they may have no claim against the Runner or against SENDA except where the Runner caused the loss intentionally, or where SENDA failed to provide its own Platform service with reasonable care.
Photo evidence at pickup and drop-off is the main way to show what condition the item was in. If the Sender skips photos, their position in a dispute is weaker.
12.2 How to raise a dispute
- Open a dispute in the Job screen within [72 hours] of the Runner marking delivered, or before tapping confirm — whichever is earlier.
- Upload photos, chat screenshots, and a short description of what is wrong (not delivered, wrong item, damage, no-show).
- SENDA will pause escrow release.
- SENDA will review the record and may ask both parties questions. Target first response: two business days.
- Possible outcomes: release to Runner; full or partial refund to Sender; split; or hold pending Police or insurer involvement.
SENDA's decision on escrow is an administrative decision about the held funds. It is not a court judgment about legal liability. Either party can still take their own legal advice or file in the Disputes Tribunal.
12.3 SENDA's own liability
To the maximum extent permitted by New Zealand law, and subject always to the Consumer Guarantees Act for consumers, SENDA is not liable for:
- loss of or damage to items carried by a Runner;
- the acts or omissions of Senders or Runners;
- a Runner's lack of insurance;
- delay caused by traffic, weather, or a party being late;
- indirect or consequential loss, lost profits, or loss of opportunity.
Where liability cannot be excluded, SENDA's aggregate liability to a user arising out of the Platform is limited to the greater of NZ$200 or the platform fees paid by that user to SENDA in the 3 months before the claim.
13. Privacy (summary)
SENDA collects account details, ID verification data, Job details (including pickup and drop-off addresses), device and location data while a Job is active if the user enables it, payment tokens via the payment provider, photos, chat, ratings, and support correspondence.
That information is used to run the marketplace, verify users, take and release payment, prevent fraud, handle disputes, improve the product, and meet legal duties.
Addresses for a live Job are shared with the other party to that Job only. They must not be reused after the Job ends.
Some processors will be overseas (for example a US or Australian payment or cloud provider). SENDA will only use processors it reasonably believes meet comparable safeguards, consistent with the Privacy Act 2020.

14. Intellectual property and acceptable use of the Platform
SENDA owns the app, branding, and platform software. Users keep ownership of the photos and text they upload, and grant SENDA a license to use that content to operate and promote the Platform (for example showing a furniture Job as an anonymised example).
Users must not scrape the Platform, reverse-engineer the app, interfere with other accounts, post malware, or use SENDA to send unsolicited commercial messages in breach of the Unsolicited Electronic Messages Act 2007.
15. Changes, suspension and closing an account
SENDA may update these terms. Material changes will be notified in-app or by email at least 14 days in advance where reasonably practicable. Continued use after the effective date is acceptance. Urgent security or legal changes may take effect immediately.
A user may close their account from settings, subject to finishing or cancelling open Jobs and settling balances. SENDA may keep records as required for tax, disputes and law.
16. Governing law and disputes with SENDA
These terms are governed by the laws of New Zealand. The parties submit to the exclusive jurisdiction of the New Zealand courts and tribunals, including the Disputes Tribunal for claims within its limit.
Before filing, a user should email SENDA to allow 10 working days to try resolve the issue.
